Where a person dies leaving a valid Will with appointed executors, the executors normally have to apply for probate. This is a procedure to establish whether the will is valid and confirm the appointment of executors. Often in a straightforward estate there is no need for a solicitor to be involved. However, if there are problems with the Will, or with the estate, solicitors may be appointed to help in the administration of the estate. Many people welcome this assistance at what is often a difficult time. When a person dies intestate, the intestacy rules govern who can act as an administrator and who ultimately inherits the estate. The executor / administrator is responsible for dealing with the deceased’s property, in accordance with the will / intestacy rules, and for collecting in the assets and paying debts and liabilities against the estate.
