Many married couples choose to divorce when the marriage has broken down. There is one ground for divorce and that is that the marriage has broken down irretrievably. In order to satisfy the court that this has occurred, one of five facts has to be established. There are:
- Adultery.
- Unreasonable behaviour.
- 2 years separation with consent.
- Desertion.
- 5 years separation (no consent required)
This allows the couple to separate their assets, liabilities and move on with their life.
Judicial Separation
Judicial Separation is a formal separation sanctioned by the court and also enabling the court to make orders about the division on finance and property. However, the marriage is not considered terminated and therefore the couple are not free to remarry.
It is very similar to divorce and the procedures are quite similar but at the end of the process, the couple are still married to each other unless at a later stage they decide to divorce. . Under those circumstances the couple would need to start the divorce process from the beginning.
Separation Agreement
This is a written agreement that sets out your financial arrangements while you are separated. It is mostly used when parties are considering whether to divorce or not but are certain they want to live separately.
However you are still married and the separation agreement is not legally enforceable should your spouse not comply with the agreement.
